The agreement between you and RunCards — what we expect, what we promise, and how we keep the community safe.

Welcome to RunCards. These Terms of Service ("Terms") govern your access to and use of the RunCards mobile application, website, and related services (collectively, the "Service"). Please read these Terms carefully before using our Service.

01 Acceptance of terms

By accessing or using RunCards, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service. These Terms apply to all users of the Service, including without limitation users who are browsers, runners, club administrators, or contributors of content.

02 Eligibility

You must meet the following requirements to use RunCards:

  • You must be at least 13 years of age (or the age of majority in your jurisdiction, whichever is higher)
  • You must have the legal capacity to enter into binding agreements
  • You must not be prohibited from using the Service under applicable laws
  • You must provide accurate and complete information when creating an account

03 User accounts

3.1 Account creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3.2 Account responsibility

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. RunCards is not liable for any loss or damage arising from your failure to protect your account information.

04 Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Violate any applicable local, state, national, or international law or regulation
  • Infringe upon the rights of others, including intellectual property rights
  • Harass, abuse, threaten, or harm other users
  • Post false, misleading, or deceptive information
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Upload or transmit viruses, malware, or any other malicious code
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service
  • Use the Service to track or harass individuals without their consent
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Collect or store personal data about other users without their express permission
  • Use the Service for any commercial purpose without our prior written consent

05 User-generated content

5.1 Content ownership

You retain ownership of any content you create, upload, or post through the Service ("User Content"), including but not limited to run cards, club information, meeting schedules, photos, comments, and profile information.

5.2 License to RunCards

By posting User Content on the Service, you grant RunCards a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to:

  • Use, reproduce, modify, adapt, publish, translate, and distribute your User Content
  • Display and perform your User Content in connection with the Service
  • Use your User Content for marketing and promotional purposes

This license allows us to operate, promote, and improve the Service. You represent and warrant that you have all necessary rights to grant this license.

5.3 Content standards

You are solely responsible for your User Content. You represent and warrant that your User Content:

  • Does not violate any third-party rights, including copyright, trademark, privacy, or publicity rights
  • Is accurate and not misleading
  • Does not contain illegal, harmful, or offensive material
  • Complies with all applicable laws and regulations

5.4 Content moderation

RunCards reserves the right, but not the obligation, to monitor, review, edit, or remove any User Content at any time, for any reason, without notice. We may remove content that violates these Terms or that we determine is harmful, offensive, or inappropriate.

06 Location data & safety

6.1 Location services

The Service uses location data to provide features such as run tracking, finding nearby clubs, and displaying meeting locations. By using the Service, you consent to the collection and use of your location data as described in our Privacy Policy.

6.2 Safety disclaimer

Running and physical activity involve inherent risks. You participate at your own risk and are responsible for your own physical condition.
  • You participate in running activities at your own risk
  • RunCards is not responsible for your safety during runs or club meetings
  • You should exercise caution when meeting with other users in person
  • You are responsible for your own physical condition and should consult a physician before beginning any exercise program
  • RunCards does not verify the identity, background, or intentions of other users

07 Third-party services

The Service may integrate with third-party services, including but not limited to Sign in with Apple, Sign in with Google, Strava, and Google Places API. Your use of these third-party services is subject to their respective terms of service and privacy policies. RunCards is not responsible for the practices of third-party services.

08 Intellectual property

8.1 RunCards property

The Service, including its original content, features, functionality, design, logos, and trademarks, is owned by RunCards and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8.2 Trademarks

"RunCards" and related logos are trademarks of RunCards. You may not use these trademarks without our prior written permission.

09 Prohibited activities

In addition to the restrictions set forth in Section 4, you are specifically prohibited from:

  • Creating fake or duplicate accounts
  • Manipulating or gaming the Service's features or algorithms
  • Using the Service to organize or promote illegal activities
  • Sharing your account credentials with others
  • Reverse engineering, decompiling, or disassembling any part of the Service

10 Termination

10.1 Termination by you

You may terminate your account at any time by contacting us at christopher@run.cards or through the account settings in the app.

10.2 Termination by RunCards

We may suspend or terminate your account and access to the Service immediately, without prior notice, if:

  • You violate these Terms or our Privacy Policy
  • You engage in fraudulent, illegal, or harmful activities
  • We are required to do so by law
  • We determine that your use of the Service poses a risk to other users or the Service

10.3 Effect of termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and User Content, though some information may be retained as required by law or for legitimate business purposes. Sections of these Terms that by their nature should survive termination will survive.

11 Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RunCards DOES NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Service is free of viruses or other harmful components
  • The results obtained from using the Service will be accurate or reliable

12 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RunCards SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any conduct or content of third parties on the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
  • Any injuries or damages arising from your participation in running activities or interactions with other users

IN NO EVENT SHALL RunCards' TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO RunCards IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13 Indemnification

You agree to defend, indemnify, and hold harmless RunCards, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including any intellectual property or privacy right
  • Your User Content

14 Dispute resolution

14.1 Governing law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14.2 Informal resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at christopher@run.cards. We'll try to resolve the dispute informally within 60 days.

14.3 Binding arbitration

If we cannot resolve a dispute informally, you and RunCards agree to resolve any claims through binding arbitration, except for claims that qualify for small claims court. Arbitration will be conducted by a neutral arbitrator in accordance with the rules of the American Arbitration Association.

15 Changes to terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

  • Posting the new Terms on this page
  • Updating the "Last Updated" date
  • Sending you an email notification (if you have provided an email address)
  • Displaying a notice in the app

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

16 Miscellaneous

16.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RunCards regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

16.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
